ikuTeam Office Apps for Jira and Confluence Terms of Service

Thank you for using ikuTeam Office Apps (an IKUTEAM, Lda. product). These terms of use (“Terms”) cover your use and access to our services, client software, and websites (“Services”).

Our Privacy Policy explains how we collect and use your information. By using our Services, you’re agreeing to be bound by these Terms and to review our Privacy policies. If you’re using our Services for an organization, you’re agreeing to these Terms on behalf of that organization.

ikuTeam reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Service, at any time. It is your responsibility to check these Terms periodically for changes.

Your Data and Permissions

When using services provided by ikuTeam, all files and Atlassian accounts remain private and strictly yours. We do not acquire any rights to your data beyond the limited permissions necessary to provide our services.

Infrastructure and Processing: To facilitate our Services, our app utilizes the Atlassian Forge platform for hosting and an external ikuTeam Office engine on AWS for high-performance processing. To provide these actions (such as document editing and rendering), our systems must process your data. This permission extends to our affiliates and trusted third parties, such as Atlassian and Amazon Web Services (AWS), with whom we collaborate to offer our services.

Storage Commitment: Please note that we never store your files, content, or credentials for third-party services. Data processed by our engine is handled in volatile memory and is not written to persistent storage.

While we do not store your data, please be aware that Atlassian may retain your content according to their own data storage and handling policies. ikuTeam does not influence or manage the data storage practices of Atlassian or any third-party services you connect.

Sharing Your Data

Our apps and services enable you to share your data with others. Please be mindful of what you choose to share.

Your Responsibilities

You are solely responsible for your conduct and your data. Remember, content within the services may be protected by others' intellectual property rights, so refrain from copying, uploading, downloading or sharing content without having the necessary permissions.

We may review your conduct and content for compliance with these Terms, but we have no obligation to do so. We are not responsible for any content posted and shared through our services.

Please note, our Services are not intended for use by individuals under the age of 16. By using our Services, you assert that you are at least 16 years old.

Software and SaaS

Our Services are primarily provided as Software as a Service (SaaS) integrated into the Atlassian cloud environment (via Forge) and our remote processing engine. They require no manual download or installation on your local hardware.

As long as you comply with these Terms, we grant you a limited, nonexclusive, nontransferable, revocable license to access the SaaS solely for the purpose of utilizing our Services. Unless prohibited by law, you agree not to reverse engineer or decompile our Services, attempt to do so, or assist anyone in doing so.

Our Rights

Our services are protected by Portuguese and international copyright, trademark, and other laws. These Terms do not grant you any rights to our Services, others' content within our services, or any ikuTeam trademarks, logos and brand features. We appreciate any feedback, but please note that we may use your comments or suggestions without any obligation to compensate you.

Service Access

ikuTeam Office Apps, available through the Atlassian Marketplace for Atlassian platforms, are provided to users at no cost. There is no requirement for a trial period, and users will not transition to a Paid Account following any period of use. Access to and use of ikuTeam Office Apps shall be entirely free of charge, granting users full access to all features without billing or fees.

ikuTeam reserves the right to modify, suspend, or discontinue the free access model at any future date. Any changes to the terms regarding the cost of access to ikuTeam Office Apps will be communicated to users in advance.

Termination

You may discontinue using our Services at any time. We also reserve the right to suspend or terminate the Services at our discretion and without notice if you breach these Terms, or use the Services in a way that could cause us legal liability.

Services "AS IS"

We strive to provide great Services, but there are certain things that we can’t guarantee. TO THE FULLEST EXTENT PERMITTED BY LAW, IKUTEAM AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED “AS IS.” WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some places don’t allow the disclaimers in this paragraph, so they may not apply to you.

Judicial forum for disputes: You and ikuTeam agree that any judicial proceeding to resolve claims relating to these Terms or the Services will be brought in the courts of Portugal.

NO CLASS ACTIONS: You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class action.

These Terms will be governed by Portugal and European Union law except for its conflicts of laws principles, unless otherwise required by a mandatory law of any other jurisdiction.

These Terms constitute the entire agreement between you and ikuTeam with respect to the subject matter of these Terms. These Terms create no third-party beneficiary rights.
